1. Overview
These Terms of Service ("Terms") govern your use of nickishop.shop (the "Site") and any purchase you make from Nickishop. By accessing the Site or placing an order, you agree to these Terms and to our Privacy, Shipping and Return & Refund policies. If you do not agree, please do not use the Site.
2. Eligibility and accounts
You must be at least the age of majority in your state of residence to make a purchase. You are responsible for keeping your account credentials confidential and for all activity under your account. Information you provide must be accurate and complete.
3. Products and pricing
We sell women's clothing to customers in the United States. We make every effort to display products, colors and sizing accurately, but colors may vary by screen and measurements are approximate. All prices are in U.S. dollars. Prices, products and availability may change without notice, and we may limit quantities or discontinue products at any time.
4. Orders and payment
An order confirmation email is not an acceptance of your order. We may refuse or cancel any order — for example, for suspected fraud, pricing or inventory errors — and will refund any amount charged. You agree to provide current, complete payment information and authorize us and our payment processors to charge the total amount, including applicable taxes.
5. Shipping, returns and exchanges
Shipping is free on all U.S. orders. Returns and exchanges are accepted within 30 days of delivery with free return shipping, as set out in our Shipping Policy and Return & Refund Policy, which form part of these Terms.
6. Promotions and gift cards
Discount codes and promotions are subject to their stated terms, cannot be combined unless stated, and may be withdrawn at any time. Gift cards are not redeemable for cash except where required by law.
7. Intellectual property
All content on the Site — including text, images, logos and design — belongs to Nickishop or its licensors and may not be copied, reproduced or used without our written permission.
8. Acceptable use
You agree not to use the Site for any unlawful purpose, to interfere with its security or operation, to submit false information, or to upload malicious code.
9. User content
If you submit reviews, comments or other content, you grant us a non-exclusive, royalty-free license to use, reproduce and display it in connection with our business. You confirm that your content is truthful and does not infringe anyone's rights.
10. Third-party services
The Site is hosted on Shopify and may include links to third-party websites or tools. We are not responsible for third-party content or services, which are governed by their own terms.
11. Disclaimer of warranties
Except as expressly stated, the Site and products are provided "as is" and "as available", without warranties of any kind, to the fullest extent permitted by law.
12. Limitation of liability
To the fullest extent permitted by law, Nickishop will not be liable for any indirect, incidental, special or consequential damages arising from your use of the Site or products. Our total liability for any claim will not exceed the amount you paid for the product giving rise to the claim.
13. Indemnification
You agree to indemnify and hold Nickishop harmless from claims arising from your breach of these Terms or your violation of any law or third-party rights.
14. Governing law
These Terms are governed by the laws of the State of Ohio and applicable U.S. federal law, without regard to conflict-of-law principles. Any dispute will be brought in the state or federal courts located in Licking County, Ohio, unless otherwise required by law.
